1. Agreement to terms
By accessing or using any AI4Africa website, dashboard, bot, or related service (collectively, the "Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity and that it accepts these terms.
2. Services we provide
AI4Africa provides AI automation, chatbots, and workflow orchestration tools that help businesses communicate with customers, automate tasks, and integrate with third-party platforms such as WhatsApp, SMS providers, CRMs, and payment systems. Specific features may vary based on your plan, configuration, and region.
3. Your responsibilities
When using our Services, you agree that you will:
- Provide accurate information when creating accounts or projects.
- Keep login credentials secure and notify us promptly of any suspected unauthorised access.
- Comply with all applicable laws, platform rules (for example, WhatsApp Business policies), and data protection requirements.
- Use the Services only for lawful business purposes and not for spam, fraud, harassment, or other abusive behaviour.
4. Customer data and privacy
When you or your end-users send messages, upload content, or connect data sources to our platform, you remain the owner of that data. We process it only to provide and improve the Services, in line with our Privacy Policy. You are responsible for having a lawful basis to collect and share your users' data with us.
5. Third-party services
Our Services may depend on or integrate with third-party providers such as Meta (WhatsApp), SMS gateways, cloud hosting, payment processors, and other APIs. Your use of those third-party services is subject to their own terms, and we are not responsible for downtime, changes, or actions taken by those providers.
6. Payment and usage
Some Services are billed on a pay-per-use or subscription basis. You agree to pay all applicable fees, taxes, and charges associated with your account. We may suspend or limit access to the Services if invoices are overdue or if we detect suspicious or abusive usage that puts our infrastructure or other customers at risk.
7. Intellectual property
AI4Africa owns all rights, title, and interest in and to the platform, including our software, designs, branding, and documentation, except for content provided by you or your users. You receive a limited, non-exclusive, non-transferable licence to use the Services for your business, subject to these terms.
8. Prohibited activities
You agree not to, and not to allow anyone else to, do any of the following:
- Reverse engineer, modify, or copy our platform in an unlawful way.
- Use the Services to send unsolicited bulk messages or violate messaging platform rules.
- Upload or transmit harmful, illegal, or infringing content, including malware or hate speech.
- Interfere with or disrupt the integrity or performance of our systems.
9. Disclaimer of warranties
We aim for high availability and reliability, but the Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the extent permitted by law, AI4Africa will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Services. Our total aggregate liability for any claim will be limited to the amounts you paid us for the Services in the twelve (12) months before the event giving rise to the claim.
11. Suspension or termination
We may suspend or terminate your access to the Services if you breach these terms, misuse the platform, or create risk or possible legal exposure for us or other users. You may stop using the Services at any time, and you remain responsible for any fees incurred up to that date.
12. Changes to these terms
We may update these Terms of Service periodically. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice through our website or email. Continued use of the Services after changes take effect means you accept the updated terms.
